This website is operated by Rogue Ritual. Throughout the website, the terms “we”, “us” and “our” refer to Rogue Ritual.

These Terms of Service apply when you access or use our website, create an account or purchase products from us. By using our website or placing an order, you agree to these Terms of Service.

Our Privacy Policy, Return and Refund Policy and Shipping Policy also apply and form part of these Terms of Service.

If you do not agree to these terms, please do not use our website or purchase products from us.

  1. USING OUR WEBSITE

You must use our website only for lawful purposes.

You must not:

  • interfere with the operation or security of the website;

  • introduce viruses, malicious code or other harmful material;

  • attempt to gain unauthorised access to the website or another person’s account;

  • use the website in a way that infringes another person’s rights;

  • impersonate another person or provide false or misleading information; or

  • reproduce, scrape or exploit any part of the website for commercial purposes without our written permission.

We may restrict or suspend access to the website where we reasonably believe that these terms have been breached or where doing so is necessary to protect the website, Rogue Ritual or its customers.

If you are under 18, you should use this website and purchase products only with the involvement of a parent or legal guardian.

  1. PRODUCT INFORMATION

We take reasonable care to ensure that product descriptions, images, ingredients, directions, warnings, prices and other information displayed on our website are accurate.

Colours, finishes and product appearance may vary slightly depending on your screen, device settings, production variations or packaging updates.

Products must be used in accordance with the directions and warnings provided with the product. Information provided through our website is general information and is not intended to replace professional medical advice.

We may update product information, limit quantities or discontinue products without notice. Changes will not affect orders we have already accepted unless required for safety or legal reasons.

  1. ORDERS

Placing an order constitutes an offer to purchase products from Rogue Ritual.

An automated order confirmation acknowledges that we have received your order but does not necessarily mean that the order has been accepted. We may decline or cancel an order where:

  • a product is unavailable;

  • there is an error in the product description or price;

  • payment cannot be authorised;

  • we reasonably suspect fraud or unauthorised activity;

  • we are unable to deliver to the address provided; or

  • the order appears to be for unauthorised commercial resale.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled product or order to the original payment method.

Please review your order carefully before submitting it. If you need to request a change or cancellation, contact us as soon as possible at han@rogueritual.com.au. We cannot guarantee that changes or cancellations can be made after an order has entered the fulfilment process or been dispatched.

Products purchased from Rogue Ritual are intended for personal or household use and must not be purchased for unauthorised commercial resale.

  1. PRICES AND PAYMENT

All prices displayed on our website are in Australian dollars and include applicable taxes unless stated otherwise.

Shipping charges, where applicable, will be displayed at checkout before payment is completed.

Prices may change without notice, but a price change will not affect an order we have already accepted.

We take reasonable care to ensure prices are accurate. If a genuine pricing or product information error occurs, we may contact you to confirm whether you wish to proceed at the correct price or cancel the affected order and provide a refund.

You must provide current, complete and accurate billing, payment and contact information when placing an order. You confirm that you are authorised to use the payment method provided.

Payments are processed through Shopify and its supported payment providers. Rogue Ritual does not directly store complete payment card details.

  1. SHIPPING AND DELIVERY

Rogue Ritual currently ships within Australia only.

Processing times, shipping options, delivery estimates, tracking, address changes and procedures for missing or damaged deliveries are set out in our Shipping Policy.

Delivery timeframes are estimates and delays outside our reasonable control may occur. This does not limit any rights or remedies available to you under the Australian Consumer Law.

  1. RETURNS, REFUNDS AND CANCELLATIONS

Our change-of-mind position and procedures for damaged, faulty or incorrect products are set out in our Return and Refund Policy.

We do not provide returns, exchanges or refunds for change of mind. This does not affect any rights you may have under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You may be entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You may also be entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

  1. ACCOUNTS

If you create a customer account, you are responsible for maintaining the confidentiality of your login details and for activity conducted through your account.

Please contact us promptly if you believe your account has been accessed without authorisation.

Information provided when creating or using an account must be accurate, current and complete.

  1. INTELLECTUAL PROPERTY

The content of this website—including the Rogue Ritual name and branding, product names, text, graphics, photographs, videos, designs and website presentation—is owned by or licensed to Rogue Ritual and is protected by applicable intellectual property laws.

You may access and use the website for personal, non-commercial purposes. You must not reproduce, republish, modify, distribute, sell or commercially exploit our content without our prior written permission.

Nothing in these terms transfers ownership of any Rogue Ritual intellectual property to you.

  1. REVIEWS AND CUSTOMER CONTENT

If you submit a product review, photograph, comment or other content to Rogue Ritual, you confirm that:

  • you created the content or have permission to submit it;

  • the content is accurate and reflects your genuine experience;

  • it does not infringe another person’s rights;

  • any incentive or benefit connected with the submission has been disclosed; and

  • it is not unlawful, misleading, abusive, defamatory or offensive.

You grant Rogue Ritual a non-exclusive, worldwide, royalty-free licence to use, reproduce and display content you submit in connection with operating, marketing and improving Rogue Ritual.

We may moderate or remove submitted content where we reasonably believe it breaches these terms or applicable law.

  1. THIRD-PARTY SERVICES AND LINKS

Our website may include links to or services provided by third parties, including payment, delivery, review and social media providers.

Third-party services may be governed by their own terms and privacy policies. Rogue Ritual is not responsible for the content or operation of third-party websites that we do not control.

Please review the relevant third party’s terms before using its services.

  1. SHOPIFY

Our online store is hosted and supported by Shopify. Shopify provides the ecommerce platform that allows us to sell products to you.

Purchases made through our store are transactions between you and Rogue Ritual. Shopify may process information relating to your use of the website and your transactions as described in our Privacy Policy and Shopify’s applicable privacy notices.

  1. PRIVACY

Our collection, use, storage and disclosure of personal information is governed by our Privacy Policy.

By using our website, you acknowledge that information may be processed by Shopify and other service providers that help us operate the store, process payments, fulfil orders and communicate with customers.

  1. WEBSITE AVAILABILITY AND ERRORS

We take reasonable care in operating our website but do not guarantee that it will always be available, uninterrupted or free from technical errors.

We may correct errors, update information or temporarily suspend parts of the website for maintenance, security or operational reasons.

To the extent permitted by law, Rogue Ritual is not responsible for indirect losses that were not reasonably foreseeable or for losses caused by your misuse of a product, failure to follow supplied directions and warnings, or unlawful use of our website.

Our liability will otherwise be determined in accordance with applicable law.

We may update these Terms of Service to reflect changes to our business, website, products, service providers or legal obligations.

The version applying to an order will generally be the version available when the order was placed, unless a change must apply earlier for legal or safety reasons.

The current version and its effective date will be published on this page.

These Terms of Service are governed by the laws of Victoria, Australia, and the applicable laws of the Commonwealth of Australia.

Any dispute will be dealt with by a court or tribunal with jurisdiction to hear it. Nothing in these terms removes any consumer protection available to you under applicable law.

  1. SEVERABILITY

If any part of these terms is found to be unlawful, invalid or unenforceable, that part will be removed or limited to the minimum extent necessary. The remaining terms will continue to apply.
